1. Introduction

These Terms of Service ("Terms") govern your access to and use of tree-family.com (the "Service"), operated by D23 Ventures Ltd ("we," "our," or "us").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

tree-family.com provides an online platform for creating, managing, and sharing family trees. Features include a visual drag-and-drop tree builder, timeline and map views, collaboration tools, and export functionality. We offer both free and paid subscription tiers.

3. Account Registration

• You must be at least 16 years old to create an account
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately at hello@d23.tech if you suspect unauthorized access to your account

4. Your Content

4.1 Ownership

You retain full ownership of all content you create on the Service, including family tree data, photographs, biographical text, and other materials ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing and improving the Service.

4.2 Acceptable Use

You agree not to use the Service to:

• Upload content that violates any applicable law or regulation
• Infringe on the intellectual property or privacy rights of others
• Distribute malware, spam, or other harmful content
• Attempt to gain unauthorized access to the Service or its infrastructure
• Use automated tools to scrape, crawl, or extract data from the Service
• Impersonate another person or entity

5. Privacy of Family Members

When adding personal information about living individuals to your family tree, you represent that you have obtained their consent or have a legitimate basis for including their information. You are solely responsible for ensuring that your use of the Service respects the privacy rights of the individuals in your family tree.

6. Subscriptions and Payments

• The Service offers a free tier with limited features and paid Pro subscriptions with additional capabilities
• Paid subscriptions are billed in advance on a monthly or annual basis, as selected at the time of purchase
• All payments are processed securely by Stripe. We do not store your payment card details
• Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date
• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period
• We do not offer refunds for partial billing periods. If you believe you are entitled to a refund due to a service issue, contact us at hello@d23.tech

7. Intellectual Property

The Service — including its design, source code, features, branding, and documentation — is the property of D23 Ventures Ltd and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

9. Termination

We may suspend or terminate your account if you materially breach these Terms, engage in abusive or fraudulent behaviour, or fail to pay applicable fees. We will provide reasonable notice where practicable.

You may delete your account at any time from your account settings. Upon deletion, your data will be permanently removed within 30 days, except where we are required to retain it for legal or compliance purposes.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the accuracy or completeness of genealogical information entered by users.

11. Limitation of Liability

To the maximum extent permitted by applicable law, D23 Ventures Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. If you are a consumer in the European Union, nothing in these Terms affects your rights under mandatory consumer protection legislation in your country of residence.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
